The problem of "environmental refugees": between the lack of international legal recognition and the search for protection

Existe una creciente necesidad por comprender la multiplicidad de causas que llevan a un grupo de personas a desplazarse por situaciones de vulnerabilidad y emergencia. Paralelamente, estudiar el impacto del cambio climático en distintas esferas de la vida humana, incluyendo la movilidad humana, se ha convertido en una urgencia a nivel mundial. Al unir estas dos preocupaciones se llega a la discusión alrededor de la migración ambiental y sus distintos componentes. Este es el el caso de los refugiados ambientales (como se les ha denominado en gran parte de la literatura académica), personas que se ven forzadas a migrar por motivos ambientales. Entre estos motivos se encuentran la degradación ambiental, los desastres naturales exacerbados por el cambio climático, la falta de planeación y prevención frente a estos desastres, y, en general, la irresponsabilidad en las actividades humanas. Ninguno de los factores mencionados, ni la migración forzada por razones ambientales, son nuevos en la historia de la humanidad. Sin embargo, su estudio se hace cada vez más relevante en la medida en que el número de personas afectadas por éstos aumenta. La necesidad de visibilizar esta nueva realidad de refugio y de proteger a este creciente población migrante es fundamental. Esto es evidente dada la falta de normativa internacional específica para los refugiados ambientales y en los vacíos de la normativa actual para refugiados y desplazados. Si se le prestara atención a estos vacíos, la protección del refugiado ambiental no sería el único problema resuelto. Resolver este problema llevaría al reconocimiento de la existencia de incongruencias entre los órdenes jurídicos actuales para proteger a los refugiados (stricto sensu) y los instrumentos legales disponibles para proteger a nuevas categorías de migrantes.There is a growing need to comprehend the multiplicity of reasons that lead to human displacement in the context of vulnerability and emergency worldwide. Simultaneously, understanding the impact of climate change in different spheres of human life, including human mobility, is a matter of global urgency. Bringing these concerns together has led to discussions around environmental migration and its different components. This is the case of environmental refugees (as they are referred to in great part of academic literature), people who are forced to migrate because of environmental reasons. Among those reasons, there is environmental degradation, natural disasters aggravated by climate change, lack of planning and prevention in face of such calamities, and overall irresponsible human activity. None of these factors are new to the history of humanity, nor is forced displacement because of environmental causes. However, its study becomes more relevant as the number of people affected by this type of situation increases. The need to make this new reality of refuge visible and to protect this growing refugee population is essential. This is evident due to the lack of specific international normative for environmental refugees and the gaps in current international refugee and displacement normative. If such gaps were addressed, protecting this new category of refugees would not be the only problem solved. Solving this would lead to the realization of existing inconsistencies within and between the legal instruments to protect refugees (stricto sensu) and those available to protect new categories of migrants.InternacionalistaPregrad
